1. Acceptance of Terms
By accessing or using BeYou (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
BeYou is a social media platform designed for the LGBTQ+ community. We provide features including video sharing, live streaming, direct messaging, and community engagement tools. Certain features may be released in staged rollouts and marked as coming soon.
3. Platform operator
The Service is operated by Be You Live, LLC, a Wyoming limited liability company, located at 30 N Gould St, Ste N, Sheridan, WY 82801. The brand name “BeYou” is a product of Be You Live, LLC.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate and complete information when creating your account
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be at least 18 years old
5. Community Guidelines
You agree to use BeYou in a manner that is respectful and inclusive. Prohibited conduct includes:
- Harassment, bullying, or hate speech
- Sharing content that is illegal, harmful, or violates others’ rights
- Impersonating others or providing false information
- Spam, scams, or fraudulent activity
- Violating intellectual property rights
- Nudity or explicit sexual content is not allowed

5.1 Content Review & Pre-Publication Screening
All content uploaded to BeYou — including photos, videos, live streams, and other user-generated content — is reviewed and screened by a combination of automated systems and trained human moderators before it is published, to confirm that it is not illegal and does not violate these Terms, our Community Guidelines, or our Content Compliance Standards. Content that does not pass this pre-publication review is rejected and is not published. BeYou additionally conducts ongoing automated monitoring of published content and acts on user reports as described in Section 9.
6. Content Ownership
You retain ownership of content you post on BeYou. By posting content, you grant us a license to use, display, and distribute your content on the Service. You represent that you have the right to grant this license.
7. External Links & Third-Party Content
Users may include external links in their profile bios and posts to share relevant content hosted on third-party websites and platforms. BeYou does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party websites or services.
External links must comply with the following:
- Links must not direct users to websites that contain sexually explicit, pornographic, or adult content of any kind.
- Links must not direct users to websites that promote illegal activity, violence, harassment, or hate speech.
- Links must not be used to circumvent BeYou's Community Guidelines or these Terms of Service.
- Links must not contain malware, phishing schemes, or deceptive redirects.
- Links to e-commerce, personal websites, social media profiles, and other lawful platforms are permitted.
BeYou reserves the right to remove any external link that violates these Terms or poses a risk to platform integrity. Repeated violations may result in account suspension or termination in accordance with our enforcement policies.
Clicking an external link will take you away from BeYou. We encourage users to exercise caution when visiting third-party websites.
8. Payments & Monetization
BeYou offers paid features (for example, Rainbow Coins and creator premium features) and creator monetization (for example, memberships, gifts, and tips where available). Payments are processed by third-party payment providers (including Stripe).
- Refund requests for Rainbow Coins and one-time purchases are handled on a case-by-case basis by our payment processor’s consumer support department.
- Subscriptions can be cancelled at any time and remain active until the end of the current billing period; refund requests are handled case-by-case by our payment processor’s consumer support department.
- Creators who receive payouts must complete Stripe Connect onboarding and comply with Stripe requirements.
Some creator payout features use Stripe Connect and Stripe-hosted onboarding/dashboard experiences.
Prohibited Monetization
Creators and users may not use BeYou’s payment features (including tips, subscriptions, paid content, or Rainbow Coins) to monetize the following categories of content:
- Adult content and services: Content containing nudity, explicit sexual acts, pornography, or any material primarily intended for sexual gratification. This includes subscriber-only nude images, adult audio or video, and adult live-chat features.
- Intellectual property infringement: Content that infringes on the copyright, trademark, or proprietary rights of any third party, including but not limited to leaked or pirated music, video, software, or other copyrighted material.
- Violent extremism and hate speech: Content that engages in, encourages, promotes, or celebrates unlawful violence or physical harm, or targets any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.
- AI-generated prohibited content: Any artificial-intelligence generated content that falls into the above categories.
Violation of these monetization rules will result in immediate demonetization, forfeiture of pending payouts, and potential account termination. BeYou actively monitors content using automated systems and human review to enforce these policies.
9. Reporting & Content Removal
BeYou provides reporting tools that allow end-users, rights holders, and other aggrieved parties to report content that violates these Terms or our Acceptable Use Policy and request its removal.
In-app reporting
Every video, profile, comment, message, and live stream on BeYou has a Report button (flag icon). Logged-in users can file a report by selecting a reason (e.g., spam, harassment, hate speech, explicit content, violence, underage content, impersonation, self-harm, scam) and optionally providing additional details. All reports are confidential.
Email-based reporting
Rights holders and third parties who are not platform users may request content removal by contacting:
- support@beyou.live — for DMCA takedown requests, intellectual property claims, safety concerns, abuse reports, and AUP violations
Review process
Our moderation team reviews all reports within 24 hours. Reports involving minors or self-harm are automatically escalated for priority review. Actions may include content removal, account warnings, demonetization, suspension, or permanent bans depending on severity. Reporters receive a confirmation and may check report status. Appeals can be submitted to support@beyou.live.
9.5. Sensitive Content
BeYou allows users to post media containing mature themes (suggestive imagery, partial nudity, graphic violence in art or commentary) provided they mark it as sensitive at upload time. Our sensitive-content gate replicates X (formerly Twitter)’s implementation:
- Each post may be flagged with one of three categories: nudity, violence, sensitive.
- Flagged media is shown blurred to viewers who have not opted in via Settings → Privacy.
- Logged-out viewers cannot see flagged media at all.
- Users must be 18+ (verified) to opt in to viewing flagged media.
- Flagged media does not appear in algorithmic discovery (For You feed) for users who have not opted in.
- Ads do not run adjacent to flagged media.
Hard ceiling: Explicit pornographic content (visible genitals, sex acts, sexual fluids in sexual context) is NOT permitted on BeYou under any circumstance, even when flagged. The sensitive-content flag is intended for “suggestive but not explicit” material. Violators are banned and content is removed.
Highly visible surfaces: Profile photos, headers, live stream cover images, and community banners must NOT contain sensitive content. These surfaces are visible by default and are not subject to the gate.
iOS App Store note: Per Apple App Store policy, the “Display media that may contain sensitive content” toggle is only available via web (beyou.live/settings/privacy). This is not BeYou’s preference; it is an App Store requirement.
10. Repeat Violators & Enforcement Escalation
BeYou maintains a three-strike escalation policy for users who repeatedly violate these Terms or our Acceptable Use Policy:
- Strike 1 — Warning: The violating content is removed and the user receives a formal warning notification explaining the specific policy violated. For creators, monetization features may be temporarily restricted.
- Strike 2 — Temporary Suspension: Account is suspended for 7–30 days depending on severity. All monetization is paused and pending payouts are held. The user is notified of the suspension duration and reason.
- Strike 3 — Permanent Ban: Account is permanently terminated. All pending payouts are forfeited. The user is prohibited from creating new accounts.
Severe violations (e.g., content involving minors, credible threats of violence, terrorism, or non-consensual intimate content) may result in immediate permanent termination without prior strikes. BeYou reserves the right to report such content to the appropriate law enforcement authorities.
Strike history is tracked per account and does not expire. Users may appeal enforcement actions by contacting support@beyou.live. Appeals are reviewed within 48 hours by a senior moderator not involved in the original decision.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in harmful behavior. You may delete your account at any time through your settings.
12. Limitation of Liability
BeYou is provided “as is” without warranties. We are not liable for any damages arising from your use of the Service, including but not limited to content posted by other users.
13. Governing Law & Venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Subject to the arbitration provisions in Section 14, the exclusive venue for any permitted court action is the state and federal courts located in Wyoming, and you consent to personal jurisdiction there. Where the mandatory consumer-protection law of your place of residence applies and cannot lawfully be waived, nothing in these Terms is intended to deprive you of that protection.
14. Dispute Resolution; Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS. YOU MAY OPT OUT WITHIN 30 DAYS — SEE 14(g).
(a) Informal resolution first. Before starting an arbitration, you and Be You Live, LLC agree to try to resolve the dispute informally for at least 30 days after a written Notice of Dispute is sent to support@beyou.live describing the dispute and the relief sought.
(b) Agreement to arbitrate. The Federal Arbitration Act governs this Section. Except for the carve-outs in 14(h), you and Be You Live, LLC agree that all disputes arising out of or relating to these Terms, the Service, your account, payments and chargebacks, age verification, content removal, consent and 18 U.S.C. § 2257 matters, and account suspension or termination will be resolved by binding, individual arbitration.
(c) Administrator and rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, as modified by this Section. The rules and forms are available at adr.org.
(d) Delegation; order of precedence. The arbitrator has exclusive authority to resolve any dispute about the interpretation, scope, applicability, or enforceability of this arbitration agreement, except that a court (not an arbitrator) decides the enforceability of the class-action waiver in 14(e). If any other BeYou agreement contains a conflicting dispute-resolution provision, this Section controls.
(e) Class-action and class-arbitration waiver; jury waiver. Disputes will be arbitrated only on an individual basis. You and Be You Live, LLC waive any right to bring or participate in a class, collective, consolidated (except as administered under 14(f)), or representative action, and waive any right to a jury trial. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
(f) Mass arbitration; bellwether batching. If 25 or more similar arbitration demands are submitted by or with the coordination of the same or coordinated counsel, the AAA Mass Arbitration Supplementary Rules apply and the demands will be administered in sequential batches beginning with a set of bellwether cases, after which the parties will mediate the remaining cases in good faith. The statute of limitations and any applicable filing fees are tolled for claims awaiting their batch. If your claim has not been assigned to an active batch within 180 days, you may elect to (i) proceed with your individual claim outside the staged process or (ii) bring your individual claim in a court permitted by 14(h).
(g) 30-day right to opt out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing support@beyou.live with the subject line “Arbitration Opt-Out” and your account email. Opting out does not affect any other part of these Terms.
(h) Carve-outs. Either party may (i) bring an individual claim in small-claims court, and (ii) seek injunctive or other equitable relief, or bring claims for intellectual-property infringement, DMCA / 17 U.S.C. § 512 matters, § 2257 or non-consensual-content matters, or account-security and anti-piracy matters, in the Wyoming courts identified in Section 13.
(i) Severability. If any part of this Section is found unenforceable, the rest remains in effect — except that if the class-action waiver in 14(e) is found unenforceable as to a particular claim, then that claim (and only that claim) will proceed in a court permitted by 14(h) rather than in arbitration, and class arbitration is never permitted.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
